The NEW 2020 California Employment Law broadens rights for Employees
In 2019, the California Supreme Court issued a decision which expanded the rights of workers in California. In the Dynamex case, the California Supreme Court issued a decision that makes many workers who were previously classified as independent contractors now employees of companies. That means that those workers could be entitled to additional wages and benefits.
After the California Supreme Court’s decision was issued, the California Legislature passed a law making Dynamex apply. The law is known as AB 5. AB 5 makes it harder for businesses to classify workers as independent contractors by codifying and expanding the so-called “ABC Test” established by Dynamex Operations West v. Superior Court of Law Angeles, a case decided by the California Supreme Court in April 2018.
Under the “ABC” test, businesses can classify their workers as contractors only if they can satisfy three conditions:
